Legal basis

The Tobacco and Non-Smoker Protection Act (TNRSG) came into force in May 2016, transposing the corresponding EU Directive (2014/40/EU) into Austrian law. The aim of this directive is to harmonise the requirements for tobacco products across the EU, improve health protection and prevent young people from starting to smoke.

The Tobacco and Non-Smoker Protection Act regulates the placing on the market of tobacco products and related products, including all novel tobacco products, herbal smoking products, electronic cigarettes and their liquids.

Anyone who places tobacco products or related products on the market has extensive obligations. These range from reporting extensive data (such as ingredients, emissions, toxicological data and sales volume) on each individual product to the EU CEG (EU Common Entry Gate), to the corresponding labelling and compliance with numerous prohibitions (such as advertising, sponsorship, supply to persons under the age of 18, mail order).
