Pursuant to Section 9 (1) TNRSG, the Federal Minister of Health must monitor compliance with the provisions of the TNRSG and its ordinances. For this purpose, the Federal Ministry appoints official inspection bodies from among the employees of AGES to carry out inspections.

• The inspection bodies are authorised to inspect all places where tobacco products and related products are placed on the market.
• In the course of these inspections, production and distribution records may be inspected and samples of tobacco and related products may be taken to the extent necessary for verification.
• In addition, every distributor must send samples of each product once a year on request for the purpose of official inspection.
